RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

    THIS IS A BINDING LEGAL AGREEMENT.

    CLARIFY ANY QUESTIONS OR CONCERNS BEFORE SIGNING.

    BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

    PLEASE READ CAREFULLY!

    This Agreement must be signed by the Participant or, if the Participant is under 18 years old, by their parent/guardian before participation. Any reference to the Participant's acknowledgment or agreement shall be understood to include the parent/guardian's acknowledgment or agreement when the Participant is a minor.

    ACTIVITIES AND ACKNOWLEDGMENT OF RISKS
    1. The Participant enters this Agreement with Saskatoon Prairieland Park Corporation and their respective parent companies, subsidiaries, affiliates, predecessors, successors, assigns, directors, officers, shareholders, members, employees, contractors, volunteers, staff, owners, agents, sponsors, instructors, coaches, owners/operators of the facility in which the Activities take place, and all other persons or entities acting in any capacity on their behalf (collectively the "Released Parties").

    2. Participation in any parade activities (including but not limited to riding, walking, preparing, setting up, dismantling parade floats, vehicles, and equipment, observing, supervising, or being present in any capacity) (collectively, the "Activities") requires the execution of this Agreement.

    3. The Participant agrees to comply with all rules, regulations, policies, procedures, and instructions set forth by the Released Parties for participation in the Activities and use of the facilities, whether written or verbal. The Participant acknowledges and agrees that participation in the Activities involves inherent and unforeseen risks, hazards, and dangers that no amount of care, caution, instruction, or expertise can fully eliminate, including, without limitation, the potential for serious bodily injury, permanent disability, paralysis, and loss of life. These risks include:

      • Ability: failing to act safely or within the Participant’s own ability or within designated areas

      • Advice: negligent advice regarding the Activities

      • Conduct: the Participant’s conduct and conduct of other persons, including any physical altercation between participants

      • Health and Injuries: exposure to weather conditions including heat, cold, sun, or precipitation; physical exertion; dehydration; fatigue; cardiovascular risks; orthopedic injuries; death; serious neck and spinal cord injuries which may render the Participant permanently paralyzed or brain damaged; serious injury to bones, joints, ligaments, muscles, tendons and other aspects of the body; concussions or other head injuries; transmission of communicable diseases, including viruses, COVID-19, bacteria, parasites or other organisms; and other medical emergencies

      • Premises and Travel: defective, dangerous, or unsafe condition of the facilities; falls; collisions with objects or barriers; dangerous, unsafe, or irregular conditions on surfaces; and travel to and from the premises or Activities

      • Parade Activities: the inherent risks of parade participation, including but not limited to: falling from or being thrown from parade floats; collisions with other participants, vehicles, or structures; injuries from mounting or dismounting floats; being struck by thrown items or parade materials; exposure to weather conditions; and injuries from sudden stops or movements of parade vehicles

      • Use of parade equipment: use of parade floats, vehicles, mechanical devices, decorative elements, or any other equipment used in connection with parade participation, mechanical failure of such equipment (regardless of cause or timing); negligent design, manufacture, maintenance, or inspection of the parade equipment; the provision of, or the failure by, the Released Parties to provide any warnings, directions, instructions, or guidance as to the use of the parade equipment; failure to wear safety or protective equipment; failure to use or operate parade equipment within the Participant’s own ability

      • Travel: travel to and from the Activities

    4. Such risks may result from the Participant’s own actions or inactions, the actions or inactions of others, the conditions of the premises, equipment failure or malfunction, or the negligence of the Released Parties or otherwise.

    TERMS

    In consideration of the Released Parties allowing the Participant to participate in the Activities, the Participant agrees:

    • That the Participant’s mental, emotional, and physical condition is appropriate to participate in the Activities...

    • To cease any activity immediately should they feel any discomfort, pain, dizziness, or any other symptoms...

    • To be financially responsible for all costs associated with any emergency medical treatment...

    • To comply with all rules, regulations, and requirements relating to the Activities or equipment...

    MANDATORY INSURANCE REQUIREMENTS

    • Valid Third-Party Auto Liability insurance with a minimum coverage of $2,000,000.

    • The Participant is responsible for their own liability coverage.

    • Saskatoon Prairieland Park Corporation must be named as an additional insured.

    INDEMNITY, RELEASE AND WAIVER OF CLAIMS

    The Participant acknowledges and agrees to the following terms:

    • To an unqualified assumption of all risks arising out of participation in the Activities...

    • To accept and fully assume all such risks and the possibility of personal injury...

    • To forever and irrevocably indemnify, defend, and hold harmless the Released Parties...

    SEVERABILITY

    If any provision of this Agreement is held invalid, illegal, or unenforceable, that provision shall be severable and replaced with a valid provision that most closely approximates its intent and economic effect. All other provisions shall remain in full force and effect.

    ACKNOWLEDGMENT

    The Participant acknowledges and agrees that they have been provided with sufficient opportunity to review and consider the terms and conditions of this Agreement before signing...

    AGREEMENT ACCEPTANCE

    THIS DOCUMENT IS SIGNED VOLUNTARILY AND WITHOUT DURESS, FRAUD, UNDUE INFLUENCE, OR IMPROPER INDUCEMENT.
